1. About these Terms of Use

These Terms of Use apply to the use of the TAPDX Tags website. They apply whether or not anything is bought, and they apply from the moment the website is opened.

TAPDX Tags is the business these Terms of Use are about, and it is the name used throughout them. It is operated by Iconic Connex (Pty) Ltd, and references to TAPDX, TAPDX Tags, we, us or our mean that business in its operation of TAPDX Tags. References to you or your mean the person using the website.

These Terms of Use are about using the website. Buying from TAPDX is governed by the Terms of Sale, and by the other policies applicable to the particular order, product, promotion or service. Where another TAPDX policy deals with a matter specifically, that policy applies to that matter and the rule is not repeated here.

Nothing in these Terms of Use removes a right that applies by law.

2. Who may use this website

The website may be read and browsed by anyone.

Placing an order, holding an account, accepting a quotation, approving an order or sending material through the website requires a person who is legally able to enter into the transaction concerned, as set out in the Terms of Sale.

Where a person who is not yet an adult wishes to use the website to place an order, that should be done by a parent or guardian, or with their assistance and consent.

3. The website and what belongs to TAPDX

The material on this website belongs to TAPDX or is used by TAPDX with permission.

That material includes, where applicable, the design and layout of the website, its text, photographs, product images, illustrations, graphics and videos, the written guidance and product descriptions, the elements a person interacts with on screen, the software and the way the information behind it is organised, the original documents TAPDX produces, and the particular combinations and arrangements in which all of those are put together.

A destination page means the page a TAPDX Tag opens when it is tapped. Where TAPDX builds structures for those pages, or templates describing how a particular kind of interaction or customer journey is put together, those structures and templates are TAPDX material as well. They are more than the look of a page: they can set out what information should appear, the order in which it appears, which parts are required and which are optional, what action is recommended and how the journey is intended to run.

TAPDX does not claim to own a general idea. Networking, product launches, exhibitions, property marketing, websites, landing pages, customer journeys, templates as a concept, and the tapping and scanning technologies themselves are not TAPDX's to own and TAPDX does not claim them. What TAPDX protects is its own work: its wording, its designs, its software, its structures and the material it has built.

Third-party names, trademarks and logos referred to on the website remain the property of their owners, and the position on those is set out in the Third-Party Platforms and Trademarks notice.

4. What you may do with what is here

You may read the website, browse it, and view, print or save pages for your own personal use or to decide whether to buy something.

You may share a link to a page on the website, and you may show the website to somebody else.

You may keep a copy of anything TAPDX provides to you about your own order, including a quotation, an invoice, a proof, a confirmation and the record of what you confirmed when ordering.

Nothing in these Terms of Use prevents genuine discussion, criticism, commentary or reporting about TAPDX.

5. What you may not do with what is here

Without written permission from TAPDX, you may not copy, reproduce, republish, distribute, sell, licence or commercially exploit the content of this website, and you may not present TAPDX photographs, product images, written guidance or design as though they were your own or another business's.

You may not remove or obscure a notice of ownership, and you may not use TAPDX content to advertise or sell a product that is not a TAPDX product in a way that suggests the content belongs to it.

You may not take a substantial part of TAPDX's material and use it to rebuild what TAPDX has built. That means you may not systematically extract, copy or reconstruct TAPDX's templates, the structures behind its destination pages, the way its information is organised, its software, its original writing or its collected material in order to reproduce, resell, licence, rebrand or commercially exploit that material outside TAPDX. This applies whether the copying is done by hand or by software.

This section does not stop anybody developing their own product, their own customer journey or their own template using their own work and their own ideas.

Quoting a short extract and saying where it came from, for the purpose of comment, review, reporting or discussion, is not restricted by this section.

6. Presenting the website as somebody else's

You may link to the TAPDX website in the ordinary way.

Without written permission from TAPDX, you may not frame, mirror, embed or reproduce a substantial part of the TAPDX website inside another website, application or service in a way that makes TAPDX's material look as though it belongs to somebody else, hides where it came from, suggests a partnership or connection that does not exist, presents what TAPDX does as though another service were doing it, or lets somebody else make money out of the TAPDX website without permission.

Ordinary browser behaviour, the preview a search engine shows, the preview a social media platform shows when a link is shared, and ordinary linking are not restricted by this section.

7. The TAPDX name and brand

The name TAPDX Tags, the TAPDX brand, the TAPDX logos and the way TAPDX products are presented are used by TAPDX in its business.

They may not be used by anyone else in a way that suggests that they belong to that person, that TAPDX endorses them, that they are an authorised reseller, or that there is a partnership, sponsorship or other connection with TAPDX that does not exist.

Referring to TAPDX by name in order to identify TAPDX or a TAPDX product, accurately and without implying a connection, is not restricted by this section.

8. Using the website properly

The website should be used for the purposes it is provided for: looking at TAPDX products, ordering them, giving the information an order needs, sending the material an order needs, managing and tracking your own orders, getting help, and reading the information published here.

You may not use the website to do anything unlawful, to impersonate somebody else, to place an order you do not genuinely intend to complete, to submit information you know to be false or misleading, or to interfere with another person's use of it.

You may not attempt to gain access to an account, an order, a document or a part of the website that is not yours, and you may not attempt to work around a restriction that is there to protect somebody else's information or the security of the website.

9. Automated collection and interference

You may not use software, scripts or automated tools to collect, copy, monitor or rebuild TAPDX's material at scale without permission, and you may not use automated means to place orders, submit requests, create accounts or send messages through the website.

You may not attempt to disrupt the website, overload it, place artificial or fraudulent orders through it, work around the limits on how often a request may be made, introduce malicious code into it, test its security without permission, or interfere with the systems or networks it runs on.

TAPDX limits how often certain requests may be made, and uses ordinary measures to detect and slow automated submissions.

Ordinary search engine indexing and crawling that respects the technical controls the website publishes, technology a person uses to reach the website because of a disability, ordinary browser behaviour, and anything TAPDX has agreed to, are not restricted by this section. What this section exists to prevent is misuse, interference and copying at scale, not somebody finding the website in the normal way.

10. Your TAPDX account and reaching your own order

A TAPDX account is created from the name and email address given when an order is placed. There is no password to set and no separate registration step.

Because of that, access to your own orders depends on the email address and order details you supplied. Anyone with access to that email address may be able to reach the information connected to it.

You are responsible for keeping your own email account and your own devices reasonably secure.

If you believe somebody has reached your order information without your permission, tell TAPDX so that it can be looked into and reasonable steps can be considered to protect it.

Where TAPDX has a reasonable basis to believe an account or an email address is being used by somebody it does not belong to, TAPDX may restrict or protect the information connected to it while the matter is looked into.

11. Information and material you send through the website

Information sent through the website, including an order, a request, a support message, a delivery address and the web address a tag is to point at, should be accurate and should be information you are entitled to give.

Personal information is handled in accordance with the Privacy Policy and POPIA Notice.

Artwork, logos and other material submitted for a Custom or Bulk order are dealt with in the Custom and Bulk Order Policy and in the Third-Party Platforms and Trademarks notice.

Where you send artwork, a logo, a photograph or other protected material for TAPDX to use on your order, you confirm that you are entitled to send it and to allow TAPDX to use it for that order.

12. Reviews, photographs and anything else you send us to publish

Where TAPDX invites a review, a photograph, a video, a testimonial or other material and you choose to send it, what you send stays yours. Sending it to TAPDX does not transfer ownership of it to TAPDX, and TAPDX does not become the owner of your work merely because you allowed it to be published.

What you do give TAPDX, by choosing to send it for that purpose, is permission to use it for that purpose. That permission is not exclusive, which means you may still use your own material however you like.

The permission covers what publishing it actually needs: keeping it, copying it, showing it, publishing it, laying it out for the website, resizing or cropping an image where the page needs it, showing it beside the product it relates to, using it in TAPDX's own website, social media or promotional material in a way consistent with why you sent it, and keeping a record that you sent it.

Where a review is shown publicly it appears under a shortened form of your name rather than your full name.

What you send should be your own honest account of your own experience. It should not contain another person's personal information without a proper basis, material belonging to somebody else that you have no right to give, unlawful or defamatory material, or anything you are deliberately putting forward as true when it is not.

TAPDX may decline to publish, or may remove, material that breaks this section, another TAPDX policy or applicable law.

If you later ask TAPDX to stop using something you sent for promotion, TAPDX will stop where it is reasonably able to. That does not reach a record TAPDX is entitled or required to keep, and it does not reach something already printed or already published in a form that cannot be recalled.

Sending a review or any other material is voluntary. Support, a remedy on an order and a right you have in law are never made to depend on leaving a positive review, and declining to publish a review does not affect any remedy you are entitled to.

What is given for leaving a review, and the rules that apply to it, are set out in the Rewards, Referral and Promotional Benefits Terms.

13. Accuracy of what is published here

TAPDX takes reasonable care with the information published on this website, including product descriptions, specifications, guidance and availability.

Even so, an error can occur, and information can become out of date between the moment it is published and the moment it is read. A description, an image, a specification, an availability state or a published figure may therefore be corrected.

Where an obvious or material error affects the price or another essential term of a transaction, the position is set out in the Payment, Pricing and Store Credit Policy rather than here.

Guidance published on the website, including setup and care information, is given to help rather than as a promise that a particular result will be achieved on a particular device.

14. Photographs of products and how a product actually looks

Photographs, renders and other pictures on the website are there to help somebody understand what a TAPDX product is.

How a physical product looks can differ from a picture of it, because of the screen it is being viewed on, that screen's settings, the light it is photographed or seen in, the batch of material it is made from, how the surface reflects, the way it was produced, what it is printed on, its texture, and the ordinary variation of manufacturing.

A picture on the website should therefore not be read as a promise that every physical product will look identical in every light and on every screen.

Where a product is materially different from its description or from a specification that was approved, because of something TAPDX got wrong, that is dealt with under the Cancellation and Returns Policy and the other policies applicable to the order.

Where a picture is shown as an example of what can be made rather than as a product held in stock, the Custom and Bulk Order Policy says so and sets out what happens if a mould or other additional work turns out to be needed.

15. The website being available

TAPDX intends the website to be available and working, and takes reasonable steps towards that.

The website is provided as it is at the time it is used. TAPDX does not promise that it will always be available, that it will be free of interruption, that every page will work on every device or browser, or that it will be free of every error.

The website may be unavailable from time to time because of maintenance, a change being made, a failure in a service TAPDX depends on, or an event outside TAPDX's reasonable control.

TAPDX may change, move, suspend or withdraw any part of the website, and may change what the website offers, without being required to give notice. Where a change affects an order already placed, that order is governed by the terms applicable to it when it was placed.

16. Links to other websites and services

The website may link to a website or service operated by somebody else, and a TAPDX Tag may open one.

TAPDX does not control how those services are run. Whether they are available, what is on them, the rules they set for their own accounts, how they moderate, what they charge, what they require technically, how they handle personal information, how secure they are, what they change and whether they keep operating are all matters for the business that runs them.

17. Restricting access to the website

TAPDX may restrict or withdraw access to the website, or to part of it, where there is a reasonable basis to believe it is being used in a way that breaks these Terms of Use, is unlawful, is dishonest, interferes with the website, is being used to reach somebody else's information, is abusive automated activity, is copying TAPDX's material at scale without permission, or creates a material risk to the security of the website.

TAPDX will not use this section because somebody has complained, has asked a difficult question, has exercised a right, has asked for help, has disputed an order or is simply dissatisfied.

Restricting access does not remove an obligation TAPDX already owes on an existing order, and does not affect a right that applies by law.

18. Responsibility for using the website

You are responsible for the device, connection, browser and software you use to reach the website, and for keeping your own device, email account and other systems reasonably secure.

TAPDX does not promise that the general information on the website will suit every visitor's particular purpose.

So far as the law allows, TAPDX is not responsible merely because somebody suffers a loss that arises only from the website being interrupted or briefly unreachable, from the website not working on a device or browser it does not support, from relying on general information that was not given as a specific commitment, from another business's website or platform failing on its own, from that person's own device, connection or software, or from an expectation that using the website would produce a particular business result.

Where TAPDX has actually undertaken something in connection with a purchase or a service, that undertaking is governed by the terms applicable to that transaction and is not removed by this section.

Where TAPDX's responsibility on a purchase is limited, that limit is set out in the Terms of Sale and is not repeated here.

Nothing in these Terms of Use excludes or limits TAPDX's responsibility for something the law does not permit TAPDX to exclude or limit.

19. No promise about what using a TAPDX Tag will achieve

The website may show examples, demonstrations, suggested uses, customer journeys and explanations of how TAPDX products can be used. Those are there to illustrate what is possible.

Unless TAPDX has agreed to a specific commitment in writing, TAPDX does not promise that using the website, a TAPDX Tag or a suggested customer journey will produce a particular number of enquiries, bookings, sales, clients or sign-ups, or any particular amount of income.

What actually happens depends on matters TAPDX does not control, including what is being offered, the page the tag points at, who sees it, where the tag is placed, how it is priced, how an enquiry is followed up, and how people choose to behave.

20. How this fits with the other TAPDX policies

These Terms of Use sit alongside the other TAPDX policies rather than replacing any of them.

Buying is governed by the Terms of Sale. Cancelling and returning is governed by the Cancellation and Returns Policy. Delivery is governed by the Delivery and Shipping Policy. Payment, pricing and Store Credit are governed by the Payment, Pricing and Store Credit Policy. Personal information is governed by the Privacy Policy and POPIA Notice. What the website stores on a device is governed by the Cookies and Website Tracking Policy. Custom and Bulk orders are governed by the Custom and Bulk Order Policy. Other businesses' platforms and trademarks are governed by the Third-Party Platforms, External Services and Trademarks notice. Referrals, review thank-yous and promotional offers are governed by the Rewards, Referral and Promotional Benefits Terms.

Where a specific policy deals with a matter in more detail, that policy applies to that matter.

21. Services TAPDX may add later

TAPDX may add further services over time, including tools for building and managing the pages a tag opens.

Where a new service needs terms of its own, because it creates rights or obligations going beyond ordinary use of this website, TAPDX may publish separate terms for it. Those separate terms apply only where they are presented as applying to that service.

Adding a new service does not change the terms that governed an order already completed.

22. Changes to these Terms of Use

TAPDX may revise these Terms of Use as the website develops, and a revised version applies from its stated effective date onwards.

TAPDX will not use a later version to change the terms that genuinely applied to an order already completed.

23. Governing law and rights that apply anyway

These Terms of Use are governed by the laws of the Republic of South Africa.

Where applicable law gives a person a right that cannot lawfully be excluded, waived or limited, that right applies whatever these Terms of Use say.

A right that the law gives in one situation is not thereby a right in every other situation.

Nothing in these Terms of Use creates a further right to cancel, to a refund, to a replacement or to compensation beyond what TAPDX has actually offered or what the law requires.
