The What Happens Next Kit · version 1.0

The What Happens Next Kit Licence

Effective 10 October 2026

This licence governs your purchase, access to and use of The What Happens Next Kit.

It is an agreement between you and Iconic Connex (Pty) Ltd, trading as TAPDX (“TAPDX”, “we”, “us” or “our”).

By purchasing the kit and ticking “I have read and agree to The What Happens Next Kit Licence”, you confirm that:

Important — please read before accepting

The What Happens Next Kit is a business journey-design and planning resource.

Your purchase does not guarantee sales, revenue, conversion, engagement, customers, business opportunities or any other particular commercial result.

Your standard licence is for use in your own business.

It does not allow you to reproduce, redistribute, resell, teach, facilitate, commercialise, reconstruct or provide the kit or its method as a service to other people or clients.

TAPDX may suspend or terminate access for serious or repeated misuse in accordance with this licence.

The provisions dealing with availability, business outcomes, responsibility for implementation and limitations of liability affect the allocation of risk between you and TAPDX and should be read before you accept this licence.

Nothing in this licence removes any right that South African law does not permit you to waive.

1. What you are purchasing

Your purchase gives you a limited, personal, non-exclusive, non-transferable and non-sublicensable licence to access and use The What Happens Next Kit in accordance with this licence.

Your licence is connected to:

  • your registered TAPDX account;
  • your purchase; and
  • the business for which you purchased the kit.

You are purchasing the right to use the kit.

You are not purchasing:

  • ownership of the kit;
  • ownership of TAPDX intellectual property;
  • ownership of the TAPDX methodology;
  • the right to redistribute the kit;
  • the right to provide access to other people;
  • a consulting licence;
  • a facilitator licence;
  • a training licence;
  • a reseller licence;
  • an agency licence; or
  • a licence to use the kit as the basis of a commercial service for clients.

Any additional rights must be expressly granted by TAPDX in writing.

2. Your access

Your purchase gives you access to the version of The What Happens Next Kit that you purchased, together with updates that TAPDX releases as updates to that product, subject to this licence.

An update does not automatically include:

  • a separate TAPDX product;
  • a new product created in the future;
  • separately priced functionality;
  • premium functionality;
  • separately sold templates;
  • additional modules sold separately;
  • consulting;
  • implementation services;
  • facilitated workshops;
  • training;
  • professional licences;
  • agency licences;
  • team licences;
  • client-use licences; or
  • anything TAPDX expressly identifies as a separate paid product or service.

If “lifetime access” is advertised

If TAPDX describes the kit as including lifetime access, this means continuing access while:

  • The What Happens Next Kit remains an active TAPDX product or service; and
  • TAPDX continues to operate the technology reasonably required to provide that access.

“Lifetime access” does not mean:

  • the lifetime of the purchaser;
  • that TAPDX must exist indefinitely;
  • that TAPDX must maintain the same technology indefinitely;
  • that every future TAPDX product must be included;
  • that TAPDX may never replace, migrate, restructure or retire technology; or
  • that separately created products or services become part of your purchase.

TAPDX may change the technology used to deliver the kit provided that this does not unlawfully remove rights already purchased by you.

3. Your account is personal to you

Your account and sign-in belong to the licensed user.

You may not:

  • share your username or password;
  • permit another person to log in using your account;
  • allow simultaneous or rotational use of one account by two or more people;
  • lend your account;
  • rent your account;
  • transfer your account;
  • sell your account;
  • assign your licence;
  • sublicense your licence; or
  • use one individual licence as a substitute for licences required for additional users.

If TAPDX offers a team or multi-user licence, additional users must be covered by the applicable licence.

4. What you may do

You may use the kit to design, think through, test, document, improve and implement journeys for your own business.

You may use your resulting thinking and work in connection with your own:

  • products;
  • services;
  • customer journeys;
  • launches;
  • campaigns;
  • events;
  • exhibitions;
  • networking;
  • marketing;
  • sales activity;
  • customer engagement;
  • customer experiences;
  • internal planning;
  • operational processes;
  • business development; and
  • business implementation.

You may apply what you genuinely learn through using the kit in the ordinary operation of your business.

5. Sharing your own outputs

You may share your own completed business outputs with employees, contractors, suppliers or implementation partners where they reasonably need those outputs to perform work for your business.

For example, you may give a designer, developer or marketing supplier the final journey or instructions they need to implement something you designed.

This does not give that person permission to:

  • access your TAPDX account;
  • use the kit independently;
  • copy the kit;
  • obtain the underlying templates or methodology;
  • reproduce the kit;
  • use TAPDX material for another customer; or
  • use TAPDX intellectual property for their own commercial purposes.

The distinction is:

you may share what you created for implementation; you may not share the kit itself.

6. What belongs to you

Your original:

  • business information;
  • business ideas;
  • answers;
  • decisions;
  • customer information;
  • strategies;
  • notes;
  • original content; and
  • original business outputs

that you create or enter while using the kit remain yours.

Using The What Happens Next Kit does not transfer ownership of your business information to TAPDX.

7. What remains TAPDX intellectual property

The What Happens Next Kit, together with the proprietary material forming part of it, remains the property of TAPDX or the applicable rights holder.

This includes, where legally protectable:

  • written content;
  • questions;
  • prompts;
  • exercises;
  • examples;
  • explanatory material;
  • templates;
  • original structures;
  • original frameworks;
  • original methodology;
  • journey logic;
  • sequencing;
  • arrangement of content;
  • original categorisation;
  • workflows;
  • visual assets;
  • graphics;
  • interface content;
  • product design;
  • instructional material;
  • original downloadable material; and
  • other proprietary components of the kit.

Purchasing the kit does not transfer any of those rights to you.

Where your completed work includes both your material and TAPDX material:

  • your original contribution remains yours; and
  • the underlying TAPDX material remains TAPDX property.

9. What you may not do

Unless TAPDX expressly gives you written permission, you may not:

Account and access misuse

  • share your TAPDX sign-in;
  • allow another person to use the kit through your account;
  • sell, rent or lend access;
  • sublicense the kit;
  • provide access as part of another membership or service.

Copying and reproduction

  • copy substantial portions of the kit;
  • reproduce the kit;
  • duplicate the kit;
  • photograph the kit for redistribution;
  • screenshot the kit for redistribution;
  • screen-record the kit for redistribution;
  • record the kit for redistribution;
  • download content where TAPDX has not provided a download function;
  • systematically reproduce questions, examples or exercises; or
  • create an unauthorised offline copy of the kit.

Distribution

You may not distribute TAPDX proprietary content through:

  • email;
  • messaging services;
  • shared drives;
  • cloud folders;
  • websites;
  • social media;
  • membership platforms;
  • learning-management systems;
  • document libraries;
  • course platforms;
  • online communities;
  • internal company repositories accessible beyond permitted implementation needs; or
  • any other distribution mechanism.

Commercial exploitation

You may not:

  • resell the kit;
  • sell copies of it;
  • sell access to it;
  • sell substantially reproduced templates from it;
  • package it into another paid product;
  • include it in a paid membership;
  • include it in a paid course;
  • use the kit itself as the deliverable in a paid service; or
  • charge another person to access or complete the kit.

Training and facilitation

You may not:

  • teach The What Happens Next Kit;
  • train people in the TAPDX kit;
  • facilitate the kit for clients;
  • run workshops based substantially on the kit;
  • turn the kit into a course;
  • turn it into a coaching programme;
  • present the TAPDX methodology as your own;
  • certify other people in its use; or
  • create training materials reproducing substantial portions of it.

Client work

The standard licence does not permit you to use the kit itself as the underlying product or repeatable methodology for work delivered to clients.

You may not purchase one licence and then use it repeatedly to design journeys on behalf of different paying clients where you are effectively commercialising TAPDX's kit or proprietary methodology.

A separate professional, facilitator, agency or client-use licence may be required where offered.

Reconstruction

You may not:

  • reconstruct the kit;
  • reproduce its proprietary structure in another application;
  • copy its journey flow into another platform for commercial distribution;
  • recreate substantial elements in Notion, Google Docs, software or another digital product;
  • alter headings while reproducing substantially the same proprietary resource;
  • rearrange copied material to create an apparently different product;
  • translate substantial proprietary material for redistribution; or
  • reproduce the kit in another format to avoid the restrictions in this licence.

Competitive products

You may not use substantial TAPDX proprietary material to develop, market or sell a competing:

  • toolkit;
  • template library;
  • journey builder;
  • digital workbook;
  • course;
  • software product;
  • commercial framework;
  • methodology;
  • facilitator product; or
  • substantially similar commercial resource.

This restriction does not prevent you from independently creating products or services using your own knowledge, ideas, experience and independently developed material.

10. Artificial intelligence, automated extraction and scraping

You may use ordinary technology to help implement your own resulting business work.

Using the kit’s own “Copy my prompt” feature as intended, to work on your own business, is permitted.

However, you may not use TAPDX proprietary content to reproduce or commercialise the kit through artificial intelligence or automation.

Without written TAPDX permission, you may not systematically upload, ingest, scrape, extract or submit substantial TAPDX proprietary content into:

  • a generative AI model;
  • an AI assistant;
  • an AI agent;
  • a retrieval system;
  • a knowledge base;
  • a vector database;
  • a training dataset;
  • a fine-tuning dataset;
  • an automated content extraction system; or
  • another machine-learning or automated system

for the purpose of:

  • reproducing the kit;
  • reconstructing the kit;
  • creating a substitute for the kit;
  • extracting the methodology;
  • creating a competing resource;
  • training another system to deliver substantially the same resource;
  • redistributing its proprietary content; or
  • commercially exploiting TAPDX intellectual property.

11. Watermarks and licence controls

TAPDX may use reasonable measures to protect licensed content.

These may include:

  • displaying your name;
  • displaying your account details;
  • displaying licence information;
  • personalised watermarks;
  • access controls;
  • device or session controls;
  • technical security measures; and
  • reasonable monitoring of unusual access patterns.

You may not deliberately remove, alter, obscure or circumvent these controls.

The use of these measures will remain subject to applicable privacy and consumer law.

12. You are responsible for what you put into the kit

You must have the legal right or appropriate authority to use information or material that you enter into the kit.

You must not knowingly use the kit to store or process material that:

  • is unlawful;
  • infringes another person's intellectual property;
  • you obtained unlawfully;
  • you are prohibited from using;
  • contains malicious code; or
  • is intended to compromise the kit or another system.

You remain responsible for information you choose to enter.

13. Confidential or sensitive business information

You should use appropriate judgement when placing confidential, regulated or highly sensitive information into any online service.

Unless the functionality expressly requires it, you should not unnecessarily enter:

  • passwords;
  • payment-card credentials;
  • authentication secrets;
  • highly sensitive identification information;
  • third-party confidential information you have no authority to process; or
  • information prohibited from being placed into the service.

TAPDX will process personal information in accordance with its Privacy Policy and applicable law.

14. The kit supports your thinking — it does not make decisions for you

The What Happens Next Kit is a business journey-design, planning and thinking resource.

It assists you to think through possibilities and make your own decisions.

You remain responsible for evaluating whether an idea, journey or approach is appropriate for:

  • your business;
  • your customers;
  • your industry;
  • your location;
  • your legal obligations;
  • your commercial circumstances; and
  • your particular implementation.

15. No guaranteed business result

TAPDX does not guarantee that using The What Happens Next Kit will:

  • generate sales;
  • increase revenue;
  • increase profit;
  • reduce costs;
  • improve conversion;
  • create customers;
  • create leads;
  • secure partnerships;
  • result in successful networking;
  • increase engagement;
  • create customer loyalty;
  • make an event successful;
  • make a campaign successful;
  • increase adoption;
  • result in a particular return on investment; or
  • deliver any other particular commercial result.

Business outcomes depend on many factors outside TAPDX's control.

Examples and scenarios contained in the kit illustrate ways of thinking or possible applications. They are not promises that the same outcome will occur for you.

16. No regulated professional advice

The kit is not a substitute for professional advice.

Unless expressly stated otherwise, it does not provide:

  • legal advice;
  • tax advice;
  • accounting advice;
  • financial advice;
  • investment advice;
  • medical advice;
  • regulatory advice; or
  • other regulated professional advice.

You remain responsible for obtaining specialist advice where your business activity requires it.

17. Your business implementation remains your responsibility

TAPDX provides the kit.

You control your business.

You therefore remain responsible for:

  • how you implement your journey;
  • the products or services you sell;
  • representations you make to customers;
  • prices you charge;
  • customer communications;
  • marketing claims;
  • legal disclosures;
  • permissions and consents;
  • regulatory compliance;
  • your suppliers;
  • your employees and contractors;
  • your technology choices;
  • third-party systems you connect to;
  • your operational decisions; and
  • transactions between you and your customers.

TAPDX does not become a party to a transaction between you and your customer merely because you used the kit when designing part of that customer's journey.

18. Third-party tools and services

The kit may rely on, link to or interact with services supplied by third parties.

These may include providers of:

  • hosting;
  • infrastructure;
  • authentication;
  • payment processing;
  • analytics;
  • email;
  • communications;
  • storage; or
  • other technology.

TAPDX remains responsible for obligations that applicable law places on TAPDX.

However, TAPDX does not control unrelated third-party products or services simply because the kit links to or interoperates with them.

Separate third-party terms may apply where you independently use those services.

19. Availability

TAPDX will take reasonable steps to operate and maintain The What Happens Next Kit.

Like any online product, uninterrupted or error-free availability cannot be guaranteed.

Access may temporarily be affected by:

  • planned maintenance;
  • emergency maintenance;
  • security work;
  • upgrades;
  • software defects;
  • infrastructure failures;
  • internet failures;
  • hosting failures;
  • third-party service failures;
  • cyber incidents;
  • power or communications failures;
  • force-majeure events; or
  • circumstances outside TAPDX's reasonable control.

A temporary interruption does not automatically amount to permanent failure to supply the product.

Where a material problem for which TAPDX is responsible occurs, TAPDX may, where appropriate and legally permitted:

  • investigate;
  • repair the problem;
  • restore access;
  • restore affected functionality;
  • provide a reasonable workaround; or
  • provide another remedy required by applicable law.

Nothing in this clause excludes a statutory right that cannot lawfully be excluded.

20. Changes and improvements to the kit

The kit is a digital product and may develop over time.

TAPDX may make reasonable changes to:

  • content;
  • wording;
  • examples;
  • journeys;
  • workflows;
  • layouts;
  • user interface;
  • underlying technology;
  • delivery methods;
  • security;
  • features; and
  • functionality.

TAPDX may remove or replace content that is:

  • outdated;
  • inaccurate;
  • insecure;
  • duplicated;
  • no longer useful;
  • incompatible with updated technology; or
  • being replaced with improved functionality.

An update does not give the purchaser ownership of previous or future TAPDX intellectual property.

TAPDX will not use this provision to retrospectively take ownership of your original business information or original work.

21. Saved work and data

TAPDX will take reasonable measures to protect information stored through the kit.

No online system can guarantee that data will never:

  • become temporarily unavailable;
  • be corrupted;
  • be affected by a technical fault; or
  • be lost in exceptional circumstances.

Where the kit provides an export or download facility, you should retain copies of business-critical final outputs where appropriate.

TAPDX will not deliberately delete your saved work while your account remains legitimately active except where deletion is:

  • requested by you;
  • permitted under the Privacy Policy;
  • required by law;
  • reasonably necessary for security;
  • required because content is unlawful;
  • required to protect the service or other users;
  • associated with lawful account termination; or
  • performed under an applicable data-retention policy.

22. Privacy

TAPDX may process information reasonably required to:

  • provide your account;
  • authenticate you;
  • deliver the kit;
  • save your progress;
  • process your purchase;
  • provide support;
  • protect account security;
  • detect misuse;
  • maintain licence records;
  • improve and maintain the service; and
  • comply with legal obligations.

This may include:

  • your name;
  • email address;
  • account information;
  • order information;
  • licence information;
  • licence acceptance records;
  • access and security information;
  • information you save within the kit; and
  • technical information required to operate and protect the service.

Your saved business information will not be made available to other customers.

Authorised TAPDX personnel or service providers may access information only where reasonably necessary for legitimate operational, technical, security, support or legal purposes.

TAPDX does not sell the information you save in the kit.

Personal information will be processed in accordance with TAPDX's Privacy Policy and applicable data-protection law, including POPIA where applicable.

23. Product feedback

If you voluntarily provide TAPDX with:

  • suggestions;
  • feature ideas;
  • product feedback;
  • usability observations; or
  • recommendations about improving the kit,

TAPDX may use that feedback to develop or improve its products without owing compensation for the feedback itself.

This does not transfer ownership of your confidential business information, customer information or original business content to TAPDX.

24. Protecting account and platform security

TAPDX may take reasonable measures to protect:

  • user accounts;
  • platform security;
  • data;
  • intellectual property;
  • service availability; and
  • other customers.

These measures may include investigating:

  • unusual login behaviour;
  • suspected account sharing;
  • automated scraping;
  • unauthorised copying;
  • attempts to circumvent security;
  • fraudulent activity;
  • malicious activity; or
  • unusual access patterns reasonably indicating misuse.

An investigation does not itself mean that TAPDX has concluded that a breach occurred.

25. Temporary suspension

TAPDX may temporarily suspend or restrict access where it reasonably believes this is necessary to:

  • contain a security threat;
  • prevent ongoing unauthorised distribution;
  • investigate suspected serious account misuse;
  • stop systematic extraction or scraping;
  • prevent fraudulent access;
  • protect another user's information;
  • comply with law; or
  • prevent material ongoing infringement of TAPDX rights.

Where reasonably appropriate, TAPDX will inform you of the reason for the restriction and give you an opportunity to respond.

A temporary protective suspension must not be used arbitrarily.

26. Breach of this licence

Where you breach this licence and the breach can reasonably be corrected, TAPDX may give you notice requiring you to correct it within a reasonable period or any period required by applicable law.

Examples include:

  • unauthorised account sharing;
  • unauthorised publication;
  • unauthorised copying;
  • unauthorised client use;
  • misuse of TAPDX proprietary material; or
  • violation of reasonable platform security requirements.

Where legally required, TAPDX will provide the notice and opportunity to remedy required by applicable law.

27. Serious breaches

Certain conduct may require immediate protective action.

This may include:

  • deliberate theft of TAPDX proprietary material;
  • deliberate commercial redistribution;
  • deliberate resale of unauthorised access;
  • fraudulent account use;
  • systematic scraping or extraction;
  • deliberate circumvention of security controls;
  • malicious interference with the platform;
  • deliberate disclosure of another user's information;
  • substantial unauthorised reconstruction of the product; or
  • conduct creating a material security risk.

TAPDX may temporarily suspend access while such conduct is investigated.

Termination will remain subject to applicable law.

28. Termination

TAPDX may terminate your licence where:

  • you materially breach this licence;
  • the breach is not corrected after legally required or reasonable notice where correction is possible;
  • termination is permitted by applicable law; or
  • serious deliberate conduct makes continued access legally or reasonably untenable.

Termination ends your right to access the kit.

Termination does not transfer TAPDX intellectual property to you.

29. What you may retain after termination

After termination you may continue to own and use:

  • your original business information;
  • your original ideas;
  • your original content;
  • your original decisions; and
  • your legitimate business outputs created while you were properly licensed.

You may not continue to:

  • distribute TAPDX proprietary content;
  • use unauthorised copies of the kit;
  • resell TAPDX material;
  • provide the kit to others;
  • retain material you were never entitled to copy; or
  • commercialise reconstructed TAPDX proprietary content.

30. Rights that continue after termination

The provisions relating to the following continue to apply where relevant after access ends:

  • intellectual-property ownership;
  • unauthorised reproduction;
  • unauthorised distribution;
  • confidentiality where applicable;
  • misuse of TAPDX material;
  • liability;
  • dispute resolution;
  • electronic records;
  • accrued rights; and
  • any provision which by its nature is intended to survive termination.

31. Protecting TAPDX intellectual property

If TAPDX reasonably believes its proprietary material has been:

  • copied;
  • distributed;
  • resold;
  • publicly disclosed;
  • reconstructed;
  • commercially exploited; or
  • used outside the licence,

TAPDX may require the unauthorised conduct to stop.

TAPDX may require unauthorised reproductions or publications to be removed or destroyed where legally appropriate.

TAPDX may also exercise any rights or remedies available under contract, intellectual-property law or other applicable law.

Nothing in this licence prevents TAPDX from seeking urgent relief from a competent court where reasonably necessary to stop continuing:

  • intellectual-property infringement;
  • unauthorised disclosure;
  • security interference;
  • unlawful access; or
  • other serious ongoing harm.

32. Claims resulting from your unlawful material or conduct

To the extent permitted by law, you remain responsible for losses or third-party claims caused directly by:

  • material you knowingly upload without the legal right to use it;
  • your deliberate infringement of a third party's rights;
  • fraudulent use of the service;
  • deliberate unlawful conduct carried out through the service; or
  • deliberate unauthorised commercial exploitation of TAPDX proprietary material.

This does not make you responsible for loss caused by TAPDX.

33. TAPDX's responsibility

TAPDX remains responsible for obligations that applicable law requires it to bear.

Nothing in this licence excludes or restricts liability where doing so is prohibited by law.

In particular, nothing in this licence is intended to exclude liability for TAPDX conduct where exclusion is legally prohibited, including liability arising from fraud, wilful misconduct or gross negligence to the extent that such liability may not lawfully be excluded.

34. Limitation relating to business outcomes

Subject always to rights and liabilities that cannot lawfully be excluded or limited, TAPDX is not responsible for indirect or consequential business losses resulting merely from your decision to use or implement a journey created through the kit.

This may include claimed loss of:

  • anticipated profits;
  • anticipated revenue;
  • anticipated savings;
  • prospective customers;
  • business opportunities;
  • reputation; or
  • expected commercial benefit,

where the claimed loss results from your own commercial implementation or from an outcome the kit never guaranteed.

The kit supports business decision-making. It does not insure the commercial outcome of those decisions.

35. No blanket exclusion of statutory rights

Nothing in this licence:

  • removes a right that cannot legally be removed;
  • requires you to waive a right protected by applicable law;
  • prevents you from approaching a regulator, ombud, tribunal or court where the law gives you that right; or
  • limits a remedy that applicable law says may not be limited.

Where this licence conflicts with a mandatory provision of applicable law, that mandatory provision takes precedence to the extent of the conflict.

36. Refunds

Refunds, cancellation rights and other purchase-related remedies are governed by:

  • applicable law;
  • the TAPDX Terms of Sale; and
  • the TAPDX policy on when an order can be cancelled or returned.

Accessing a digital product does not automatically remove a consumer right that applicable law says continues to exist.

Similarly, nothing in this licence creates an additional refund right beyond a right provided by law or expressly promised by TAPDX.

37. Payment disputes and fraud

If a payment associated with your account is:

  • reversed;
  • cancelled;
  • disputed;
  • identified as potentially fraudulent; or
  • subject to a chargeback,

TAPDX may temporarily restrict access while the payment status is investigated.

TAPDX will not use this clause to prevent a consumer from lawfully disputing a payment or exercising a statutory right.

Where the original payment is lawfully reversed and TAPDX is no longer entitled to retain the purchase price, continued licensed access may end, subject to applicable law and the circumstances of the dispute.

38. Changes to this licence

TAPDX may update this licence where reasonably necessary because of:

  • changes in law;
  • changes to the product;
  • new functionality;
  • security requirements;
  • technology changes;
  • operational requirements; or
  • clarification of existing terms.

TAPDX will not retrospectively use a new licence version to claim ownership of your existing original business information.

Where a material change affects existing users' rights or obligations, TAPDX will communicate the change in an appropriate manner and obtain further acceptance where applicable law requires it.

TAPDX will retain records of the licence version associated with your acceptance.

39. No waiver

If TAPDX does not immediately enforce a provision of this licence, that does not automatically mean TAPDX has waived the right to enforce it later.

A waiver of a right in one situation does not automatically waive the same right in another situation.

40. Severability

If a court or other competent authority determines that part of this licence is unlawful or unenforceable, that part will be treated as ineffective only to the extent necessary.

The remainder of the licence will continue to apply where legally possible.

41. Transfer by TAPDX

You may not transfer your licence without TAPDX's written permission.

TAPDX may transfer or assign its rights and obligations relating to the kit as part of:

  • a lawful business restructuring;
  • sale of the relevant business or product;
  • merger;
  • acquisition; or
  • transfer to a successor entity,

provided that doing so does not unlawfully remove your existing consumer rights.

42. Entire licence for use of the kit

This licence contains the terms governing your permitted use of The What Happens Next Kit.

It operates together with the applicable:

  • TAPDX Terms of Sale;
  • TAPDX policy on when an order can be cancelled or returned; and
  • TAPDX Privacy Policy.

Those documents address different aspects of the transaction and should be read together.

If TAPDX gives you additional written rights under a:

  • team licence;
  • professional licence;
  • facilitator licence;
  • agency licence;
  • client-use licence; or
  • other special written permission,

those additional rights apply to the extent expressly stated.

43. Resolving a concern

If you have a concern about:

  • your account;
  • access;
  • payment;
  • saved information;
  • kit functionality;
  • a suspension;
  • a licence decision; or
  • another matter relating to the kit,

you may contact TAPDX using the customer-support contact information published on the TAPDX website.

Please provide enough information for TAPDX to investigate the matter.

TAPDX should have a reasonable opportunity to investigate and respond before formal proceedings are commenced, except where:

  • urgent relief is reasonably required;
  • the law provides otherwise;
  • a regulator may be approached directly;
  • a statutory time period requires earlier action; or
  • urgent protection of rights is required.

44. Disputes

If a dispute arises, you and TAPDX should first make a reasonable good-faith attempt to resolve it directly.

Either party may provide written notice setting out:

  • the nature of the dispute;
  • the relevant facts; and
  • the outcome being requested.

Nothing in this process prevents either party from seeking urgent relief where reasonably necessary.

Nothing in this clause prevents a consumer from approaching a body, ombud, regulator, tribunal or court where applicable law allows them to do so.

45. Governing law

This licence is governed by the laws of the Republic of South Africa.

Any dispute will be subject to the jurisdiction and dispute-resolution rights provided by applicable South African law.

46. Electronic acceptance and evidence

You agree that TAPDX may maintain electronic records relating to:

  • your identity;
  • your TAPDX account;
  • your order;
  • the date of purchase;
  • the licence version presented to you;
  • the date and time you accepted it;
  • the method of acceptance;
  • access history;
  • relevant security information;
  • notices sent to you; and
  • communications concerning your licence.

Subject to applicable law, these electronic records may be used as evidence of:

  • the transaction;
  • the terms presented;
  • acceptance of the licence; and
  • subsequent account activity.

47. Access to the licence

You must be given an opportunity to review this licence before accepting it.

TAPDX will make the applicable licence available in a form that may reasonably be accessed after purchase.
