1. Nothing in any TAPDX policy waives a right the law gives you
Nothing in these Terms of Sale, the TAPDX Tags Setup, Compatibility, Use & Care Guide or any other TAPDX policy is intended to exclude, limit or waive any rights you have under applicable South African consumer law. Where the Consumer Protection Act 68 of 2008 applies to your purchase, you retain the rights and remedies it provides to you.
2. How TAPDX assesses a tag that has stopped working
TAPDX Tags should be programmed, used and cared for in line with the product information, specifications and reasonable setup and care instructions supplied for the product. Where a product is reported as defective or not functioning correctly, TAPDX may assess the product and the circumstances of its use to distinguish a product failure or manufacturing defect from a loss of functionality that arose after delivery — for example from physical damage, permanent locking or alteration of the tag, use contrary to the supplied instructions, or use outside the stated specifications. This does not remove any statutory right or remedy available to you under South African law.
